Booking Conditions Dracosailing (individual participants)

All bookings are accepted under the following conditions:

1. Confirmation and payment:

Bookings are confirmed only after the signed contract or travel reservation is received by us. The deposit has to be credited to our bank account at the latest three weeks after the date of the invoice. The remaining amount is received by us no later than seven weeks before the start of the tour concerned. If these payment terms are not met, we reserve the right to a cancellation.

2. Cancellation:

If a contract is cancelled, a cancellation fee will be owed from each participant. Cancellations of Agreement are subject to the following provisions:

-Until 56 days before the day of departure: € 70, – per person.

-From the 56th day (inclusive) until the 28th day before the day of departure: the whole deposit.

-From the 28th day (inclusive) until the 14th day before the day of departure: 50% of the fare.

-From the 14th day (inclusive) until the day of departure: 75% of the fare.

-On the day of departure: the full amount of the fare.

3. Participants of bike and boat tours agree to follow orders from the captain regarding navigation and any other instructions in the interest of navigation. The orders of the skipper include the symbols on board the ship.

4. Participants are responsible for their own behavior during the trip.

5. During bicycle and barge tours the skipper is entitled to change the place of departure / arrival as urgent circumstances such as wind, fog or other reasons make this necessary. If such changes occur participants do not have the right to a (partial) refund.

6. Participants are liable for damage to the ship or any third party if caused by wrongdoing on their behalf.

7. Dracosailing or its crew is not liable for material or immaterial damage that is suffered by participants during the holiday period, except for damage caused by intent or gross negligence. Neither is Dracosailing liable for any effects of the mentioned injury.

8. Both parties are entitled to terminate this agreement effective immediately without any legal consequences, if either party would not meet its obligations under this agreement.

10. Expenses, both in and out of court, arising from failure by a party of one or more articles of this agreement, are the sole responsibility of the counterparty.

11. This agreement shall be governed by Dutch law. Any disputes will be submitted to the competent court in Amsterdam.

12. It is the participants own responsibility to arrange a travel and cancellation insurance if desired.

13. If less than 4 participants have booked in a holiday-week, Dracosailing has the right to depart with our smaller boat the Draco. If 4 or more participants have booked, Dracosailing has depart with our bigger boat the Odisej.
